For over a decade, our attorney has fought to protect the right to bear arms in Illinois. This includes appealing improper or even unlawful denials and revocations by the Illinois State Police. As a law firm entirely comprised of military veterans and spouses, you can count on us to support your Second Amendment Rights and protect the lawful and responsible ownership and use of firearms.

The State of Illinois could seize your guns, thus effectively stealing those valuable assets from your heirs and family. Some gun owners have tens of thousands worth of firearms, including collectibles. A GUN TRUST estate plan may be able to protect your family's firearms for generations to come.

Most of the people we represent in gun-related criminal charges are law-abiding citizens who get into trouble because they were not fully informed of their rights. Or, they simply used a firearm to defend themselves. We take these cases very seriously. Although our attorneys also handle all forms of criminal defense, from the ordinary DUI or misdemeanor up to major Class X felony offenses, we have a lot of experience defending gun owners, and it's something we are particularly passionate about.
Commonly called a "restraining order," in Illinois these legal documents are known as Orders of Protection or OP for short. Has an angry ex accused you of something and obtained an OP? That could result in loss of FOID rights in Illinois. Maybe a neighbor called the police and made a false allegation of violence. But most OPs are obtained by people in divorces and custody battles as a way of gaining leverage and legally "exiling" the other party from the family home. While awful, we often must litigate in multiple courts, from family court to criminal court, just to protect a client's Second Amendment Rights.
Under Federal Law, those who are convicted of domestic violence, even a first offense misdemeanor, are entirely ineligible for gun ownership or possession. Illinois takes a very strict approach to this, often revoking a person's gun rights just for being accused of domestic battery, even if their case is dismissed.
If you work in law enforcement, military, or certain other positions of public trust, the federal law known as the "Lautenberg Amendment" creates a situation where you can be permanently terminated and lose your ability to earn a living in your career if convicted of even a small domestic battery crime. If you work in law enforcement, military, or certain other positions of public trust, the federal law known as the "Lautenberg Amendment" creates a situation where you can be permanently terminated and lose your ability to earn a living in your career if convicted of even a small domestic battery crime. These cases require special attention because so much is at stake. Our law enforcement, military, and true American patriots deserve better. Never give up your livelihood without a fight.
Many out-of-towners are shocked when they discover just how tough Illinois gun laws are. Many out-of-towners are shocked when they discover just how tough Illinois gun laws are. A person from an open-carry state traveling through Illinois may inadvertently run afoul by forgetting to unload the magazine of a handgun before stowing it. Or, perhaps they conceal the weapon by mistake. Some prosecutors are very aggressive with these cases, not realizing that the individual was merely doing something that perfectly legal just a few miles back on the highway. Confusion about an already unconstitutional limitation on your rights should never be a reason for a criminal conviction.

If you own a gun repair shop, dealership, or intend to put on a table demonstration at a gun show in Illinois, you have a lot to think about. There are myriads of complex laws and regulations that interlock to create real traps for the unwary. Unless you are a large corporate shop, you probably do not have in-house counsel or a regular attorney on retainer to call with questions or to double check to see if a law has changed. That is where we come in. We can help.
Each year we represent people from all over the state who have lost their gun rights and need our help to get them back. We charge a reasonable flat fee to petition the State Police directly in an effort to get the revocation lifted through the administrative channels. If this is unsuccessful, we have a litigation services available to file suit in court to have a judge overturn the decision and restore your Constitutional Right to Bear Arms. These are generally handled by paying a reasonable amount of money, which is held in trust. This acts like an escrow account. As work is performed, the money is used to pay the bills. Most cases can be handled from start to finish for less than a set of braces for your child.
Like all lawyers, we have to charge our clients our work. Sadly, it often comes at the worst time for people. So, in order to make things more affordable, we have two fees: (1) First, you will be required to pay a retainer that is proportionate to the type of crime, severity, and estimated amount of work it will take to resolve. (2) A portion of that fee is called a "reserve." This reserve is the minimum amount you will pay. In other words, if your attorney can resolve the case in an hour, the firm still keeps that minimum reserve, and the remainder of your fee is refunded. People often ask why we do this. In short, it is because when you hire an attorney, you are paying for skill and experience, not just time. Check out our detailed fee discussion here.
Imagine for a moment that you have a significant number of firearms with a high net value. Now imagine that you must enter a mental health facility due to dementia or depression or any other reason. Your FOID card is revoked, and the State Police demand that you surrender all weapons immediately. Your family, your heirs...they are in jeopardy of losing a large part of their inheritance! While guns may be sporting items or have sentimental value, at their core, they are personal property that have monetary value, and the government should not simply steal from your estate due to your medial needs. Even if you commit a crime, the government will not confiscate your estate or your home without a civil proceeding and due process. This is where our unique gun-owner estate plans are such an incredible value. We can carefully draft powers of attorney, wills, and trusts, specifically with provisions in mind to protect these assets and ensure the government has no legal right to take your children's legacy! We are the only attorneys in southern Illinois who specifically focus our estate plans on protecting Constitutional Liberties as a primary focus!
In this time in history, it is becoming almost cool to belittle and talk bad about police, first responders, and our men and women of the Armed Forces. We think that is bullSit! So, as our way of saying thank you for your incredible sacrifice, all active and retired military, veterans, and first responders receive a 10% discount off our regularly priced services.
